Terms of Service

1. Acceptance of Terms

By accessing and using the website and services of JavierAutomation, you accept and agree to be bound by the terms and provisions of this agreement.

2. Services Provided

We offer web design, development, and AI automation services. The specific deliverables are defined in your selected service tier (e.g., Landing Page, AI Enterprise).

3. Artificial Intelligence Disclaimer

IMPORTANT:

Our services may include the integration of Artificial Intelligence (AI) technologies, including chatbots and automated agents.

Accuracy: AI systems are probabilistic and can make mistakes ("hallucinations"). While we strive for high quality, JavierAutomation does not guarantee the accuracy, completeness, or reliability of any content generated by AI agents.
Responsibility: You (the Business Owner) are ultimately responsible for reviewing and verifying all information provided by the AI to your customers. JavierAutomation allows you to use these tools but accepts no liability for errors, misstatements, or offensive content generated by the AI.

4. Subscription Term & Setup Fees

4.1 Setup Fees & Waivers

The standard Setup Fee for new website projects is $999.00 USD.

Month-to-Month Option: Clients who decline the 6-month commitment must pay the full Setup Fee upfront.
Contract Incentive Waiver: Javier Automation may, at its sole discretion, waive the Setup Fee for Clients who agree to the six (6) month Initial Term. This waiver is contingent upon the completion of the Initial Term.

4.2 Subscription Term & Cancellation

Initial Term: By subscribing to the Growth or Pro plans with the "Waived Setup Fee" offer, the Client agrees to an initial minimum contract term of six (6) months.

Automatic Renewal: After the Initial Term, this Agreement shall automatically renew on a month-to-month basis. The Client may cancel at any time after the Initial Term by providing thirty (30) days' written notice.

4.3 Early Termination Fee

If the Client wishes to cancel the Service prior to the completion of the six (6) month Initial Term, the Client acknowledges that the upfront labor costs have not been fully recouped. Therefore, an Early Termination Fee shall be immediately due and payable. The Early Termination Fee shall be calculated as:

50% of the remaining balance of the Initial Term; OR
The full amount of the waived Setup Fee ($999.00 USD);
Whichever is lower.

5. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall JavierAutomation, its affiliates, or its partners be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of or inability to access or use the services.
Any conduct or content of any third party on the services.
Any AI-generated errors or inaccuracies.

6. Governing Law

These Terms shall be governed and construed in accordance with the laws of Jamaica, without regard to its conflict of law provisions.
